This Privacy Policy describes the ways in which Farley Law, LLC (“we”, “our”, or the “Company”) collect, use, and disclose information about you (“you” or “your”) when you access our website and client portal, our treasury services agreements, and any other websites, applications, or online services that link to this policy (collectively, the “Services”) through one or more of the websites: https://farleylawpllc.com, https://farleylawpllc.moxo.com, or https://treasurydocs.farleylawpllc.com (the “Site”). If you are a client, and you submit information subject to an attorney-client privilege, such information will of course be treated as confidential and will be maintained and protected accordingly.

WHAT INFORMATION THIS NOTICE COVERS.

This Privacy Notice covers information we collect from you through the Site. Some of our Site’s functionality can be used without revealing any personal data, but for features or Services we provide via the Site, Personal Data is required.

WHAT INFORMATION WE COLLECT.

DISCLOSURE OF INFORMATION.

We may share certain of your information with third parties in certain situations.  We may share your information with third-party processors as needed to serve our legitimate business interests, which include administration of our Site, administration of your account, entering into contracts with you, communicating with you, taking orders for products or Services, delivering our products or Services, identifying trends, protecting the security of our Company interests.

COOKIES AND SIMILAR TECHNOLOGIES.

Cookies are small text files placed on your device to collect standard internet log information and visitor behavior information. The cookies may transmit information via your browser with a purpose of authenticating or identifying the computer (via, e.g., the IP address) or the user. Cookies may contain information such as registration data and user preferences.

We use cookies to:

  • Automatically collect certain technical information from your computer or mobile device over time and across different websites, including when you use our Site or Services such as your browser type, operating system, device type, the page served, your IP address and your geolocation.
  • Collect and store information about your location to provide you with educational experiences or email updates that are tailored for your region. The location information we have access to may include (1) your postal zip code, if you provide one to us, and (2) the approximate geographic region your computer or mobile device is located in, as determined by your IP address. However, we do not collect your street name and the name of your city/town.

In addition, in the event our Site crashes on your mobile device, we will receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our Site. This information is sent to us as aggregated information and is not traceable to any individual and cannot be used to identify an individual.  In addition, if you choose to turn on your Bluetooth, wi-fi or other geolocation functionality when you use our Site, we may collect and use your geolocation information.
  • We may also use third-party advertising networks to collect cookie information to deliver interest-based advertising to you and provide us with statistics about the effectiveness of our advertising on third-party websites. These third-party advertising networks may use this cookie information in accordance with their own privacy policies.

When a server receives a request from a device which stores a cookie from a website, the server is able to use the information stored in the cookie in combination with the information stored on the server to allow the website to respond to you as an individual and to tailor their operations to your needs, likes, and dislikes by gathering and remembering information about your preferences. A cookie cannot collect information from your computer and cannot carry any viral or other damaging files.

DATA RETENTION; REQUEST TO DELETE.

We retain Personal Data as long as it is needed to conduct our legitimate business purposes or to comply with our legal obligations or until you ask us to delete your data.

You may request that we delete your Personal Data at any time. However, please note that we cannot control the retention policies of third parties. If you wish to have any third parties, including those to whom we have transmitted your information, delete that information, you will need to contact those third parties directly. You may request from us a list of all third parties to whom we have transmitted your information. Additionally, information that we gather for a specific purpose, such as to assist law enforcement, will not be kept for any longer than is necessary for that particular purpose.

AGE RESTRICTION.

Our Site is not designed for use by children under age 13, and we do not knowingly solicit Personal Data from anyone under age 13. If you are under age 13, do not access or use our Site or Services. Ask a parent or guardian to help you instead. If you become aware that we have collected the information of anyone under the age of 13, please contact us so that we may promptly delete that information.

CALIFORNIA PRIVACY RIGHTS.

Users who are California residents have certain rights under the California Consumer Privacy Act (“CCPA”). If you are an eligible California user included in these rights are:

  • “Right to Know” – you have the right to request to know more about the categories and specific pieces of personal information that we have collected about you and access a copy of your personal information.
  • “Right to Deletion” – you have the right to request deletion of personal information that we have collected about you.
  • “Right to Non-Discrimination” – If you choose to exercise any of your rights under CCPA, we will treat you like all other users. In other words, there is no penalty for exercising your rights under CCPA.
  • “Right to Opt-Out” – You have the right to opt out of the sale of your personal information. 

The CCPA has a specific definition of a “sale” and while we do not, in the traditional sense, sell your personal information or the personal information of any of our users, we do use cookies that make non-personally identifiable information available to select third parties.  To opt out of such a “sale”, please notify us at the mailing address listed at the top of this Privacy Policy.

To exercise any of these rights under CCPA, please write to us at the mailing address listed at the top of this Privacy Policy. CCPA allows you to designate an authorized agent to make these requests on your behalf. For your protection, we may require that you or your designated agent verify your identify before fulfilling your request.

As a California resident, you also have the right to request certain details about what personal information we share with third parties for those third parties direct marketing purposes. You may make that request by sending it to us at the mailing address located at the top of this Privacy Policy.

NEVADA USERS.

The Company does not sell its users’ Personal Data. Nonetheless, Nevada residents have the right to submit a request that we do not sell your Personal Data, which you can do by sending written notice to us at the mailing address located at the top of this Privacy Policy.

INTERNATIONAL PRIVACY PRACTICES.

Our Site is operated and managed on servers located and operated within the United States. To provide your products and Services to you, you may be sending your Personal Data outside of the country where you reside or are located, including to the United States. Accordingly, if you reside or are located outside of the United States, your Personal Data may be transferred outside of the country where you reside or are located, including to countries that may not or do not provide the same level of protection for your Personal Data.  We are committed to protecting the privacy and confidentiality of Personal Data when it is transferred. If you reside or are located within the EU, United Kingdom, Switzerland, or other region that offers similar protections, and such transfers occur, we take appropriate steps to provide the same level of protection for the processing carried out in any such countries as you would have within the EU or other regions to the extent feasible under applicable law.  We participate in and commit to adhering to the EU-US, and Swiss-US Privacy Shield Frameworks when transferring data from the EU or Switzerland to the United States. SECURITY.

The security of your personal information is important to us, and we employ physical, technical, and administrative security measures designed to safeguard the information collected by our Site. We use industry standard SSL (secure socket layer technology) encryption to transfer Personal Data. Other security safeguards include, but are not limited to, data encryption, firewalls, and physical access controls to buildings and files.

Account holders create a password when accessing our client portal or certain parts of our service.  You can help protect against unauthorized access to your account and Personal Data by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account.

Please be aware, however, that no information system can be guaranteed to be 100 percent secure, so we cannot guarantee the absolute security of your information. CHANGES TO PRIVACY POLICY.

We constantly strive to provide the best services, and accordingly our Privacy Policy will change from time to time.  If we update this Privacy Policy, we will notify you by posting the revised Privacy Policy on our Site, and for certain revisions that materially expand the ways in which we use or share the information previously collected from you through our Site, either display an alert next to the Privacy Policy, display an alert upon login to our Site, or directly communicate with you (e.g., via the email address associated with your account).  The most recent date of this Privacy Policy is located at the top of this Privacy Policy along with the date of the last update.
